The United States Patent Office (USPTO) received two (duplicate) requests for extension of time to file a statement of use (extension request) filed on the same date, i.e., April 10, 2020, and covering the same six-month extension period.  Only the first-received extension request will be reviewed and processed and the fee for the duplicate extension request will be refunded in due course.

 

An extension request must be filed within six months of the issuance date of the notice of allowance, or before the expiration of a previously granted extension period. 15 U.S.C. §1051(d)(2); 37 C.F.R. §2.89(a)-(b).  An applicant cannot file two extension requests on the same date or within the same six-month extension period.  TMEP §1108.01.
