IDENTIFICATION OF GOODS:

 

The amended identification of goods for class 4 and 21 is indefinite and must be clarified because applicant must specify the type of oil and “non-metal fluid measuring and dispensing containers” is overly broad and potentially misclassified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may adopt the following identification, if accurate: 

 

International Class 4: Motorcycle engine oil; motorcycle chain lubricant; lubricating grease; motor vehicle lubricants; fiber filter oil, namely a [applicant must specify type of oil, i.e. engine, motor, industrial]  oil aiding in filtration of particulates for vehicle air filters; foam filter oil, namely a [applicant must specify type of oil, i.e. engine, motor, industrial] oil aiding in filtration of particulates for vehicle air filters

 

International Class 20: Mirrors; lock, not of metal, for vehicles; automotive nonmetal oil change pans not of metal; motorcycle fluid drain pans not of metal; drum drain pans not of metal; non-metal bins for organizing small parts and tools; stools; Non-metallic containers for chemical fluids and fluid dispensers connectable to such containers for use therewith to dispense chemical fluids from such containers all for industrial use

 

International Class 21: Automotive oil funnels; spouted automotive oil funnels; non-metal fluid measuring and dispensing containers [this item is overly broad because it can refer to an item in class 9, 20 or 21 without further clarification- the examining attorney has suggested wording in class 20]; jug spout hose benders; jug vent caps; jug caps; jug spouts; utility jugs; wire brushes not being machine parts; carburetor jet cleaning tool, namely cleaning brushes for carburetors

 

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).
