ARGUMENT(S)
RESPONSE AND AMENDMENT Commissioner for Trademarks P.O. Box 1451 Alexandria, VA 22313-1451 Commissioner: In response to the office action dated August 22, 2019, the applicant submits the following response. AMENDMENT Please amend the description of goods/services as follows: 1. International Class 009 Coaxial cables; Cable assemblies consisting of electric cables and cable connectors; Micro coaxial cable assemblies consisting of micro coaxial cables and connectors for micro coaxial cables; Flexible coaxial cable assemblies consisting of flexible coaxial cables and connectors for flexible coaxial cables; and vapor sealed flexible coaxial cable assemblies consisting of vapor sealed flexible coaxial cables and connectors for vapor sealed flexible coaxial cables RESPONSE The office action of February 14, 2019 identified two issues. First, the office action requires a disclaimer of ?FLEX.? Second, the office action requests clarification of the identification of goods. Disclaimer The office action states the ?wording ?FLEX? in the applied-for mark is unregistrable. Applicant must provide a disclaimer of the unregistrable part of the applied-for mark even though the mark as a whole appears to be registrable.? Accordingly the applicant states ?[n]o claim is made to the exclusive right to use ?FLEX? apart from the mark as shown.? Identification of Goods The applicant has amended the goods in accordance with the office action?s suggestion. Accordingly, the applicant submits that the amended identification of goods is in accordance with the requirements of the office action and that the refusal on this ground should be withdrawn. CONCLUSION In view of the preceding response, the applicant respectfully submits that all of the grounds for refusal have been addressed.
