Importance: High

Gail:

I presume you are referring to U.S. Application Serial Nos. 88450097, 88450098, 88450099, 88450100, 88450101, 88450103, and 88450104.  Could you confirm?

I will allow the amendments because you have stated that you inadvertently submitted the incorrect identification of goods, and at least one of the submitted applications (U.S. Application Serial No. 88450104) actually had the correct proposed identification of goods.  Generally, we do not allow expansion of scope of the identification of goods as acceptably amended (submitted via response).

In addition, the identification of goods you propose in your email is still indefinite in part.  The following is suggested, if accurate:

International Class 007:  "Mechanical spreaders; hydraulic spreaders; bulk material handling equipment, namely, salt, asphalt, and other mechanical road safety, de-icing, weather-control, snow, and ice control product spreaders; material handling machines, namely, salt, asphalt, and other mechanical road safety, de-icing, weather-control, snow, and ice control product spreaders; component machine parts for material handling machines"

International Class 012:  "Truck-mounted hauling bodies in the nature of vehicle bodies; bulk material handling equipment, namely, vehicle bodies incorporating tailgate spreaders and hopper style body spreaders; vehicle bodies, namely, multi-purpose dump bodies and asphalt bodies"

Also, U.S. Application Serial No. 88450099 will be suspended subsequent to the examiner’s amendment.

These changes can be made through Examiner’s Amendment with your authorization for each of the applications referenced above.

Sincerely,

Crystal H. Yi

Dear Ms. Yi,

I inadvertently entered the incorrect descriptions for the classes.  I am hoping the correct descriptions can be made through an Examiner’s Amendment.  The correct descriptions should be:

  1. Class 7 - Mechanical spreaders; hydraulic spreaders; bulk material handling equipment, namely, salt, asphalt, and other road safety, de-icing, weather-control, snow, and ice control product spreaders; material handling machines, namely, salt, asphalt, and other road safety, de-icing, weather-control, snow, and ice control product spreaders; component machine parts for material handling machines.
  2. Class 12 - Truck-mounted hauling bodies in the nature of vehicle bodies; bulk material handling equipment, namely, tailgate spreaders and hopper style body spreaders; multi-purpose dump bodies and asphalt bodies.

Sincerely,

Gail
