I conducted a search and do not plan to refuse your mark based on any currently registered marks.  The mark you mentioned is a registered mark.  However, the purpose of publication is to provide an opportunity for other entities, such as competitors, to oppose registration of your mark.  The following page on our website discusses the steps in the trademark process:  http://www.gov.uspto.report/trademarks-getting-started/trademark-process#step5.   Publication is at Step 5.

I’ve registered an LLC called Hudson Editions LLC in New York. 

 

Please let me know if that works. 

 

If this mark is approved, it is okay to proceed with the magazine? There is a literary journal called The Hudson Review, so I want to make sure I’m in my own territory.

I am an examining attorney with the U.S. Patent and Trademark Office.  I’ve been assigned to review the  trademark application that you filed with our Office.   Before I can approve the mark for publication, there is one issue that must be addressed.  I can take care of this for you if you provide the information discussed below. 

 

Specifically, the owner of the mark is identified in the application as follows:

 

John H White, a New York limited liability company

 

In other words, you (an individual) are listed as the owner, but your entity type is a limited liability company.  If you are the owner, I just need your to provide your country of citizenship.  If the mark is owned by an LLC, I need the name of that company.

 

You can provide me this information by reply email or phone.  I will then enter it for you and send you a confirmation letter, called an Examiner’s Amendment.  I will also approve the mark for publication. 

 

If you have any questions, please let me know.
