1. The refusal to register under Trademark Act Section 2(d) based on U.S. Registration No. 5425337 is maintained and CONTINUED. Applicant’s arguments in favor of registration are noted and made part of the record. The trademark examining attorney has found applicant’s arguments unpersuasive and still believes there may be a likelihood of confusion between applicant’s mark and U.S. Registration No. 5425337.

 

2. Applicant’s disclaimer has been accepted and made part of the record.

 

3. The amendment to the identification of goods has been accepted and made part of the record.
