ARGUMENT(S)

The Examining Attorney has refused the registration of Applicant's MD and Design mark for class 09 goods on the grounds that it is confusingly similar to U.S. Registration Nos. 4950689 and 4922872 both covering services in Class 42 (the “Cited Registrations”). The examiner also cited a prior application under serial number 88252671 (the “Cited Application”) for classes 09 and 42.

Courts and trademark examiners apply the factors from Application of E. I. DuPont DeNemours & Co. to assess whether a likelihood of confusion exists between two trademarks. 476 F.2d 1357, 1361 (CCPA 1973); TMEP § 1207.01. This analysis “may focus . . . on dispositive factors, such as similarity of the marks and relatedness of the goods.” In re i.am.symbolic, llc, 866 F.3d 1315, 1322 (Fed. Cir. 2017).

The Office followed this approach and heavily on two of the thirteen DuPont factors and concluded that Applicant's MD and Design mark and the registered marks conveyed a confusingly similar commercial impression. Applicant disagrees and respectfully submits that there is no potential for confusion sufficient to bar registration under § 2(d).

No likelihood of Confusion

Courts have held that the use of identical marks in connection with products or services that differ sufficiently from one another may prevent any likelihood of confusion between the uses of the marks. See, e.g., Taj Mahal Enterprises Ltd. v. Trump, 745 F. Supp. 240 (D.N.J. 1990) (no likelihood of confusion between use of TAJ MAHAL for restaurant and use for casino and hotel). This is also true even when identical marks are used in the same field or a general category of goods. Astra Pharmaceutical Products, Inc. v. Beckman Instruments, Inc., 718 F.2d 1201 (1st Cir. 1983) (no likelihood of confusion between use of ASTRA for local anesthetic preparation versus ASTRA computerized blood analyzer machine).

While prior decisions are not binding, and each case must be decided on its own merits, prior cases nonetheless are instructive to guide both counsel and the decision maker in maintaining consistent decisions which follow the public policy of the Trademark Office.

When the goods in question are sufficiently distinct, confusion is not likely, even if the marks are identical. See, e.g., Quartz Radiation Corp. v. Comm/Scope Co., 1 U.S.P.Q.2d 1668, 1669 (TTAB 1986); see also, In re National Data Corp., 753 F.2d 1056, 1058 (Fed. Cir. 1985) (“The basic principle in determining confusion between marks is that marks must be compared in their entireties and must be considered in connection with the particular goods or services for which they are used.”); United Foods, Inc. v. United Air Lines Inc., 41 U.S.P.Q.2d 1653, 1662-63 (TTAB 1995) (unpublished decision) (no likelihood of confusion found between the mark UNITED EXPRESS for trucking division of food production company and UNITED EXPRESS for airline transportation, even though both services involved the transportation of freight, since one is by truck and the other by airplane and the products are thus unrelated). This is particularly true when elements of the mark are common and weak.

While Applicant’s mark and the Cited Mark both contain the letters “DMD,” “the question of likelihood of confusion entails consideration of the entire marks, where and how those marks are used and whether or not there are other distinguishing aspects, such as accompanying logos.” Basic American Medical v. American Medical Int’l, 649 F. Supp. 885, 891 (S.D. Ind. 1986) (BAMI and AMI not confusingly similar, even though both used in the health care industry), (citing In re E.I. du Pont de Nemours & Co., 476 F.2d 1357, 177 U.S.P.Q. 563 (C.C.P.A. 1973)).

Applicant's mark, the Cited Registration and Cited Application are all acronyms. The letters DMD in Applicant's mark refer to DIGITAL MEDICAL DATA, the cited Registrations refer to DEAD MAIL DROP and the Cited Mark refers to Marijuana Doctors. The Applicant's mark, Cited Registration and the Cited Application all stand for different words as fully depicted below:

The Cited Registrations and Cited Application are not likely to be recalled solely as DMD because they all appear used as acronyms and this is also evident by the use of their respective logo as appearing on the evidence of use submitted and attached as Exhibit A. Thus, DEAD MAIL DROP’s consumers are likely to recall the mark DMD in its logo form. Similarly, Marijuana Doctors’ consumers are also likely to recall the mark DMD in its logo form.

Moreover, three letter marks are inherently weak. Because of the prevalence of three letter marks consumers are unlikely to confuse the Applicant’s mark with the Registrant’s mark, the same way a consumer would be unlikely to confuse ABC (Reg. No. 2193567 annexed hereto) of ABC Carpet and Home with ABC (Reg. No. 2023417 annexed hereto) of ABC Broadcasting.

  1. Common Diluted Term

    The letters DMD, common between the marks, are diluted as applied to class 09, 42 and other related services of class 35. Dilution and descriptiveness of a common element can be shown by the existence of several third-party registrations, or by evidence of actual third-party use. AMF Inc. v. American League Products, Inc. 474 F.2d 1403, 1406, 177 USPQ 268,269-7- (CCPA 1973); Palm Bay Imports, Inc. v. Veuve Clicquot Ponsardin maison Fondee En 1772, 396 F.3d 1369, 73 USPQ2d 1689, 1693 (Fed. Cir. 2005) (The existence of widespread third-party use under the duPont factors may serve to indicate the weakness of a term in the context of its source identifying significance).

    Here, there are at least fourteen (14) concurrent registrations which include class 09 or 42 or 35 or a combination thereof and which include the letter DMD. See attached Exhibit B. As such, the Cited Registrations and Cited Application combine a highly diluted term (Term). The registered marks are therefore subject to a narrow scope of protection. Therefore, it is particularly unlikely that consumers will confuse Applicant's mark with the Cited Registrations or the Cited Application. A summarized table of the may also be found here:

For the foregoing reasons, there is no likelihood of confusion between the pending mark and the Cited Mark and the pending application should be approved for publication.

Different Commercial Impression

In considering the likelihood of consumer confusion between two marks, “[e]ven marks which are identical in sound and/or appearance may create sufficiently different commercial impressions when applied to the respective parties’ goods or services so that there is no likelihood of confusion.” TMEP § 1207.01(b)(v) (citing In re Sears, Roebuck and Co., 2 U.S.P.Q.2d 1312 (TTAB 1987); In re British Bulldog, Ltd., 224 U.S.P.Q. 854 (TTAB 1984); In re Sydel Lingerie Co., Inc., 197 U.S.P.Q. 629 (TTAB 1977)).

Furthermore, "the use of identical, even dominant words in common does not automatically mean that two marks are [confusingly] similar.” General Mills, Inc. v. Kellogg Co., 3 U.S.P.Q.2d 1442, 1445 (8th Cir. 1987) (finding no confusing similarity between the marks OATMEAL RAISIN CRISP and APPLE RAISIN CRISP for breakfast cereal). “Rather, in analyzing the similarities of sight, sound, and meaning between two marks, a court must look to the overall impression created by the marks and not merely compare individual features.”

In fact “[o]nce all the features of the mark are considered . . . it is not improper to state that, for rational reasons, more or less weight has been given to a particular feature of the mark, provided the ultimate conclusion rests on a consideration of the marks in their entireties.” Packard Press, Inc. v. Hewlett-Packard Co., 227 F.3d 1352, 1357 (Fed. Cir. 2000); see also Nat’l Data, 753 F.2d at 1058. In this particular case, Applicant’s marks, the Cited Registration and Cited Application are all sufficiently distinctive based on: 1) the particular significance of each mark , 2) the manner in which they are used, 3) the weakness of the term and 4) the fact that the terms is commonly used in the applied for classes. These four factors weigh heavily in showing no likelihood of confusion.

Conclusion

The differences in the marks, when they are viewed as a whole, the diluted common words between the marks all become dominant in indicating source. As such, Applicant’s mark creates a different commercial impression from the cited registrations and pending applications. Therefore, when looking at the marks as whole and in light of the crowded marketplace of similar marks and the different commercial impressions, consumers are unlikely to confuse the source of either Applicant or the cited registration. For these reasons, Applicant requests that the Examining Attorney reconsider the statutory refusal and allow the publication of Applicant's mark.

To the Commissioner for Trademarks:

Application serial no. 88443397 DMD (Stylized and/or with Design, see http://uspto.report/TM/88443397/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examining Attorney has refused the registration of Applicant's MD and Design mark for class 09 goods on the grounds that it is confusingly similar to U.S. Registration Nos. 4950689 and 4922872 both covering services in Class 42 (the “Cited Registrations”). The examiner also cited a prior application under serial number 88252671 (the “Cited Application”) for classes 09 and 42.

Courts and trademark examiners apply the factors from Application of E. I. DuPont DeNemours & Co. to assess whether a likelihood of confusion exists between two trademarks. 476 F.2d 1357, 1361 (CCPA 1973); TMEP § 1207.01. This analysis “may focus . . . on dispositive factors, such as similarity of the marks and relatedness of the goods.” In re i.am.symbolic, llc, 866 F.3d 1315, 1322 (Fed. Cir. 2017).

The Office followed this approach and heavily on two of the thirteen DuPont factors and concluded that Applicant's MD and Design mark and the registered marks conveyed a confusingly similar commercial impression. Applicant disagrees and respectfully submits that there is no potential for confusion sufficient to bar registration under § 2(d).

No likelihood of Confusion

Courts have held that the use of identical marks in connection with products or services that differ sufficiently from one another may prevent any likelihood of confusion between the uses of the marks. See, e.g., Taj Mahal Enterprises Ltd. v. Trump, 745 F. Supp. 240 (D.N.J. 1990) (no likelihood of confusion between use of TAJ MAHAL for restaurant and use for casino and hotel). This is also true even when identical marks are used in the same field or a general category of goods. Astra Pharmaceutical Products, Inc. v. Beckman Instruments, Inc., 718 F.2d 1201 (1st Cir. 1983) (no likelihood of confusion between use of ASTRA for local anesthetic preparation versus ASTRA computerized blood analyzer machine).

The Principal Register has many examples of marks which are co-existing despite being identical and being applied to related goods or services in the same class. The chart below summarizes only a few of the many examples:

While prior decisions are not binding, and each case must be decided on its own merits, prior cases nonetheless are instructive to guide both counsel and the decision maker in maintaining consistent decisions which follow the public policy of the Trademark Office.

When the goods in question are sufficiently distinct, confusion is not likely, even if the marks are identical. See, e.g., Quartz Radiation Corp. v. Comm/Scope Co., 1 U.S.P.Q.2d 1668, 1669 (TTAB 1986); see also, In re National Data Corp., 753 F.2d 1056, 1058 (Fed. Cir. 1985) (“The basic principle in determining confusion between marks is that marks must be compared in their entireties and must be considered in connection with the particular goods or services for which they are used.”); United Foods, Inc. v. United Air Lines Inc., 41 U.S.P.Q.2d 1653, 1662-63 (TTAB 1995) (unpublished decision) (no likelihood of confusion found between the mark UNITED EXPRESS for trucking division of food production company and UNITED EXPRESS for airline transportation, even though both services involved the transportation of freight, since one is by truck and the other by airplane and the products are thus unrelated). This is particularly true when elements of the mark are common and weak.

While Applicant’s mark and the Cited Mark both contain the letters “DMD,” “the question of likelihood of confusion entails consideration of the entire marks, where and how those marks are used and whether or not there are other distinguishing aspects, such as accompanying logos.” Basic American Medical v. American Medical Int’l, 649 F. Supp. 885, 891 (S.D. Ind. 1986) (BAMI and AMI not confusingly similar, even though both used in the health care industry), (citing In re E.I. du Pont de Nemours & Co., 476 F.2d 1357, 177 U.S.P.Q. 563 (C.C.P.A. 1973)).

Applicant's mark, the Cited Registration and Cited Application are all acronyms. The letters DMD in Applicant's mark refer to DIGITAL MEDICAL DATA, the cited Registrations refer to DEAD MAIL DROP and the Cited Mark refers to Marijuana Doctors. The Applicant's mark, Cited Registration and the Cited Application all stand for different words as fully depicted below:

The Cited Registrations and Cited Application are not likely to be recalled solely as DMD because they all appear used as acronyms and this is also evident by the use of their respective logo as appearing on the evidence of use submitted and attached as Exhibit A. Thus, DEAD MAIL DROP’s consumers are likely to recall the mark DMD in its logo form. Similarly, Marijuana Doctors’ consumers are also likely to recall the mark DMD in its logo form.

Moreover, three letter marks are inherently weak. Because of the prevalence of three letter marks consumers are unlikely to confuse the Applicant’s mark with the Registrant’s mark, the same way a consumer would be unlikely to confuse ABC (Reg. No. 2193567 annexed hereto) of ABC Carpet and Home with ABC (Reg. No. 2023417 annexed hereto) of ABC Broadcasting.

  1. Common Diluted Term

    The letters DMD, common between the marks, are diluted as applied to class 09, 42 and other related services of class 35. Dilution and descriptiveness of a common element can be shown by the existence of several third-party registrations, or by evidence of actual third-party use. AMF Inc. v. American League Products, Inc. 474 F.2d 1403, 1406, 177 USPQ 268,269-7- (CCPA 1973); Palm Bay Imports, Inc. v. Veuve Clicquot Ponsardin maison Fondee En 1772, 396 F.3d 1369, 73 USPQ2d 1689, 1693 (Fed. Cir. 2005) (The existence of widespread third-party use under the duPont factors may serve to indicate the weakness of a term in the context of its source identifying significance).

    Here, there are at least fourteen (14) concurrent registrations which include class 09 or 42 or 35 or a combination thereof and which include the letter DMD. See attached Exhibit B. As such, the Cited Registrations and Cited Application combine a highly diluted term (Term). The registered marks are therefore subject to a narrow scope of protection. Therefore, it is particularly unlikely that consumers will confuse Applicant's mark with the Cited Registrations or the Cited Application. A summarized table of the may also be found here:

For the foregoing reasons, there is no likelihood of confusion between the pending mark and the Cited Mark and the pending application should be approved for publication.

Different Commercial Impression

In considering the likelihood of consumer confusion between two marks, “[e]ven marks which are identical in sound and/or appearance may create sufficiently different commercial impressions when applied to the respective parties’ goods or services so that there is no likelihood of confusion.” TMEP § 1207.01(b)(v) (citing In re Sears, Roebuck and Co., 2 U.S.P.Q.2d 1312 (TTAB 1987); In re British Bulldog, Ltd., 224 U.S.P.Q. 854 (TTAB 1984); In re Sydel Lingerie Co., Inc., 197 U.S.P.Q. 629 (TTAB 1977)).

Furthermore, "the use of identical, even dominant words in common does not automatically mean that two marks are [confusingly] similar.” General Mills, Inc. v. Kellogg Co., 3 U.S.P.Q.2d 1442, 1445 (8th Cir. 1987) (finding no confusing similarity between the marks OATMEAL RAISIN CRISP and APPLE RAISIN CRISP for breakfast cereal). “Rather, in analyzing the similarities of sight, sound, and meaning between two marks, a court must look to the overall impression created by the marks and not merely compare individual features.”

In fact “[o]nce all the features of the mark are considered . . . it is not improper to state that, for rational reasons, more or less weight has been given to a particular feature of the mark, provided the ultimate conclusion rests on a consideration of the marks in their entireties.” Packard Press, Inc. v. Hewlett-Packard Co., 227 F.3d 1352, 1357 (Fed. Cir. 2000); see also Nat’l Data, 753 F.2d at 1058. In this particular case, Applicant’s marks, the Cited Registration and Cited Application are all sufficiently distinctive based on: 1) the particular significance of each mark , 2) the manner in which they are used, 3) the weakness of the term and 4) the fact that the terms is commonly used in the applied for classes. These four factors weigh heavily in showing no likelihood of confusion.

Conclusion

The differences in the marks, when they are viewed as a whole, the diluted common words between the marks all become dominant in indicating source. As such, Applicant’s mark creates a different commercial impression from the cited registrations and pending applications. Therefore, when looking at the marks as whole and in light of the crowded marketplace of similar marks and the different commercial impressions, consumers are unlikely to confuse the source of either Applicant or the cited registration. For these reasons, Applicant requests that the Examining Attorney reconsider the statutory refusal and allow the publication of Applicant's mark.
