The referenced application has been reviewed by the assigned trademark examining attorney.
DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no similar registered marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d). However, the filing dates of pending U.S. Application Serial Nos. 88005288 and 88178460 precede applicant’s filing date. See attached referenced applications. If one or more of the marks in the referenced applications register, applicant’s mark may be refused registration under Trademark Act Section 2(d) because of a likelihood of confusion with the registered marks. See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Forrest Merithew, Attorney of Record, on 6/13/2019, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. Any amendments to the identification of goods may clarify or limit the goods, but may not add to or broaden the scope of the goods. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
IDENTIFICATION OF GOODS AMENDED
The identification of goods is amended to read as follows:
Class 28 – “Stand up paddle boards, paddle boards, paddle surf boards, surf boards; Paddles for stand up paddle boards, paddle boards, paddle surf
