IDENTIFICATION OF GOODS

 

The identification of goods is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must specify the field of use in which the goods are used or intended to be used, or the specific purpose of the goods.  See TMEP §1402.01. 

 

Upon further review of this application the examining attorney the identification of goods is worded in such a way that it appears that the applicant is providing a service of the customization of product.

 

It is suggested that the applicant amend the identification to be similar the acceptable wording in the Trademarks ID Manual of “Downloadable electronic data files featuring {indicate subject matter, e.g., income tax forms, recipes}” in International Class 9.

 

Applicant may adopt the following wording, if accurate:

 

Downloadable electronic data files featuring satellite-derived geolocation information sometimes combined with satellite imagery, synthetic aperture radar, aerial imagery, and commercial data feeds. International Class 9.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

 

See id.  These refusal(s) and/or requirement(s) will be made final once this application is removed from suspension, unless a new issue arises.  See TMEP §716.01.

 

Suspension process.  The USPTO will periodically check this application to determine if it should remain suspended.  See TMEP §716.04.  As needed, the trademark examining attorney will issue a letter to applicant to inquire about the status of the reason for the suspension.  TMEP §716.05.
