USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Brian O'Donnell, Esq. on October 1, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

Amendment of Identification of Goods and/or Services

 

The identification of goods and/or services is amended to read as follows (all other goods/services remain unchanged): 

 

“Travel agency services, namely, making reservations and bookings for transportation via air, ship, rail, bus, or car; providing information, news, reviews, and commentary concerning travel via the internet and other electronic communications networks; providing a website and website links to travel information, geographic information, maps, map images, and trip routing; organizing and arranging travel activities, namely, organizing travel for others; making reservations for travel activities, namely, travel ticket reservation service; providing information about travel; organizing sight-seeing tours, namely, providing transport for sightseeing tours; travel information services; travel ticket reservation services; arranging bookings of day trips and sight-seeing tours, namely, travel ticket reservation service; providing reviews of travel service providers; travel guide services; travel route planning; providing an online searchable computer database featuring information on travel; arranging of travel visas, passports, and travel documents for persons traveling abroad,” in International Class 39;

 

“Providing information about entertainment activities, and making reservations and bookings for shows and other entertainment events; computer services, namely, providing online newsletters in the fields of travel, travel planning, travel and entertainment news, maps, city directories, and listings via electronic communication networks for use by travelers; providing information in the field of entertainment; providing entertainment activities, namely, arranging for ticket reservations for shows, attractions, and other entertainment events; providing a website where users can post ratings, reviews, and recommendations on events and activities in the field of entertainment; publishing of reviews; arranging and conducting guided tours of cities and towns, museums, historical sites, wineries, and galleries; arranging and conducting guided hiking tours; arranging and conducting guided eco tours; arranging and conducting guided fishing tours; arranging and conducting guided climbing tours; arranging and conducting guided whale-watching tours; arranging and conducting guided moped tours,” in International Class 41.
