The wording “downloadable computer software for use in the fields of . . .” in the identification of goods in International Class 9 is indefinite and must be clarified because it does not specify the function of the software.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.

 

In the identification of services in International Class 35, the wording indicated in detail below regarding “professional consulting services,” “program management,” “creative content,” “advising on the use of AI solutions and data analytics,”  “advising and consulting on the purchase and sale of digital media inventory,” “omnichannel . . .strategy,” “development of strategy and digital strategy for business,” “development of eCommerce strategy,” “development of platform-based business analytics solutions,” “advising on business solutions for information management,” “advising on, designing, and developing strategies for digitization of services/sales,” “advising on, designing, and developing mobile platforms to support field sales,” “digital engineering,” “advising on the application of intelligent systems,” “analysis of business software application portfolios,” “advising on, designing, and developing strategies for the management of front office, middle office and back office business functions,” “business process as a service (BPaaS) services featuring finance, accounting, supply chain, human resources, marketing, analytics, and asset management outsourcing services,” “quality engineering and assurance transformation services,” “user acceptance, automation, performance testing and test data management,” and “business process outsourcing (BPO) services” must be clarified because it is too broad and could include services in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  For example, “professional consulting” could encompass professional business consulting in class 35 and professional legal consulting in class 45; “program management” could encompass management of customer appreciation programs of others in class 35 and health care services, namely, disease management programs in class 44; “advising on the use of AI solutions and data analytics” could include business advice in class 35 and computer advice in class 42; “advising and consulting on the purchase and sale of digital media inventory” could include business advice in class 35 or financial advice in class 36; “omnichannel strategy” could include marketing strategy in class 35 and omnichannel technology implementation services in class 42; “development of platform-based business analytics solutions” could include business development of analytic models for the understanding and predicting of consumer, business, and retail market trends and actions in class 35 and platform-based software development in class 42; “analysis of business software application portfolios” could include business analysis in class 35 and computer software analysis in class 42; “business process as a service (BPaaS) services featuring finance, accounting, supply chain, human resources, marketing, business analytics, and asset management outsourcing services” could encompass business outsourcing services in class 35 and finance, accounting, and financial asset management outsourcing services in class 36; “business process outsourcing (BPO) services” could include human resources management in class 35, financial analysis in class 36, and business training in class 41.

 

Finally, in the identification of services in International Class 42, the wording “providing training and education in the field of information technology; “licensing . . . of proprietary and third-party software products; “support of proprietary and third-party software products”; “providing software tools for the development of computer security software”; “industry-specific technology solutions for clinical data management, pharmacovigilance, equity research support, commercial operations, and order management”; “providing on-line non-downloadable software for or in connection with artificial intelligence”; “software as a service (SaaS) services featuring software using artificial intelligence and machine learning algorithms” must be clarified because it is too broad and could include services in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  For example, providing training and education is in class 41; licensing of intellectual property is in class 45; “support of proprietary and third-party software products” could encompass support in the nature of technical advice related to the repair of associated computer devices in class 37 and technical support for software in class 42; “providing software tools for the development of computer security software” could encompass downloadable and recorded software in class 9 and non-downloadable software in class 42; “industry-specific technology solutions . . .” could encompass computer hardware and downloadable and recorded software in class 9 and non-downloadable software in class 42.

 

Applicant may substitute the following wording, if accurate:

INTERNATIONAL CLASS 45:  Licensing of proprietary and third-party software products

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

MULTIPLE-CLASS APPLICATION REQUIREMENTS

The application references goods and services based on use in commerce in more than one international class; therefore, applicant must satisfy all the requirements below for each international class:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).

 

(2)       Submit a filing fee for each international class not covered by the fees already paid (view the USPTO’s current fee schedule).  Specifically, the application identifies goods and services based on use in commerce that are classified in at least six classes; however, applicant submitted fees sufficient for only three classes.  Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

 

(3)       Submit verified dates of first use of the mark anywhere and in commerce for each international class.  See more information about verified dates of use.

 

(4)       Submit a specimen for each international class.  The current specimen is acceptable for classes 9, 35, 41 and 42; applicant needs a specimen for classes 36 and 45.  See more information about specimens.

 

            Examples of specimens for goods include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale.  Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. 

 

            Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services. 

 

(5)       Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.  See more information about verification.
