TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.  

 

This application was approved for publication on December 10, 2019.  See 37 C.F.R. §2.80.  However, approval of the application has been withdrawn to address the issue(s) below.  See TMEP §706.01.  The trademark examining attorney apologizes for any inconvenience this may cause applicant.

AMENDED IDENTIFICATION OF CLASS 42 SERVICES REQUIRED

THIS PARTIAL REQUIREMENT APPLIES ONLY TO THE SERVICES SPECIFIED THEREIN

 

The requirement for an acceptable identification of services is continued and maintained.  Upon further review, applicant must clarify the wording “providing non-downloadable software for computer security,” “providing non-downloadable software tools for the development of computer security software,” and “industry-specific technology solutions, namely, providing non-downloadable software for clinical data management, pharmacovigilance, equity research support, commercial operations, and order management” in the identification of services in International Class 42 because it is indefinite and too broad.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  This wording is indefinite because, for classification in class 42, such wording must indicate that the provided non-downloadable software is provided on-line, provided via a website, provided on a temporary basis, or is otherwise web-based.  

 

Further, the wording “providing technology information, namely, developing digital solutions for the purpose of improving business management, revenue growth, operational and administrative efficiency, costs, customer service, and compliance with regulations” and “designing and developing digital solutions for business information management;” in class 42 is indefinite and overbroad, based on the wording “digital solutions,” because it is broad enough to include services in other classes, such as designing and developing digital solutions in the nature of digital business surveys, design and development of digital marketing concepts, which are class 35 services.  Applicant must specify the nature of the “digital solutions” and classify the services accordingly.  In addition, the wording “development, implementation and technical support of proprietary and third-party software products” is indefinite, based on the wording “technical support,” because it does not specify the nature of the technical support. 

 

The wording “technical consulting services in the field of design and development of infrastructure processes” is also indefinite and overbroad, as “technical consulting” is classified by subject matter, and the subject matter “infrastructure processes” is broad enough to refer to, for example, class 35 business infrastructure processes, class 38 telecommunications infrastructure processes, and class 42 information technology (IT) infrastructure processes.  Thus, applicant must clarify the wording “infrastructure processes” and classify the services accordingly.  Additionally, the wording “technical consulting services in the field of evaluation and implementation of internet technology and services” is indefinite and overbroad because the nature of the “evaluation” is unclear.  For example, this could encompass business evaluation of information technology (IT) and internet services for business purposes in class 35, financial evaluation of information technology (IT) and internet services for financial purposes in class 36, and quality evaluation of information technology (IT) and internet services in class 42. 

 

Finally, “technical consulting services in the field of implementation of . . . internet services” is overbroad, in that “internet services” is broad enough to refer to a wide variety of services in multiple classes that are provided via the internet, such as technical consulting services in the field of implementation of internet marketing services, which is a class 35 service.  Therefore, applicant must clarify the nature of “internet services.” 

 

Applicant may substitute the following wording, if accurate: 

 

INTERNATIONAL CLASS 9:  Downloadable computer software for use in medical practice management, database management, managed health care plan management, health care insurance claim and policy adjudicating, health case management, health data profiling, data mining, data base management, data access and reporting, scheduling, decision support systems, general accounting, and exchanging data between different computer operating systems and hardware platforms; downloadable computer software for database management, data storage, data mining, data access and reporting, scheduling, data migration, data administration, and data analysis in the fields of health care, ambulatory care, managed care, life sciences, insurance, and financial services; downloadable computer software for use in business data integration, business data processing, business data analysis, and customer service; downloadable software for use in omnichannel marketing; downloadable software for enterprise automation, robotics and AI

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

MULTIPLE-CLASS APPLICATION REQUIREMENTS

The application references goods and services based on use in commerce in more than one international class; therefore, applicant must satisfy all the requirements below for each international class:

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).

 

(2)       Submit a filing fee for each international class not covered by the fees already paid (view the USPTO’s current fee schedule).  Specifically, the application identifies goods and services based on use in commerce that are classified in at least six classes; however, applicant submitted fees sufficient for only five classes.  Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.

 

(3)       Submit verified dates of first use of the mark anywhere and in commerce for each international class.  See more information about verified dates of use.

 

(4)       Submit a specimen for each international class.  The current specimen is acceptable for classes 9, 35, 36, 41 and 42; applicant needs a specimen for any additional classes.  See more information about specimens.

 

            Examples of specimens for goods include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale.  Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. 

 

            Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services. 

 

(5)       Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.  See more information about verification.
