USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. As agreed to by Mr. John M. Cone, Esq. on July 12, 2019, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
Amendment to Description of the Mark
The mark consists of a three banded circle which is green, red and yellow; in the upper portion of the three banded circle is the word "CRUZ" in stylized red letters which are highlighted in white and green; on top of the letter "C" is a yellow sombrero highlighted with yellow, red and white and which contains a green zigzagged band on the bottom and a green hat band; extending across the lower part of the three banded circle is a brown scarf design with white highlights and outlined in green and which has a red and brown fringe; below the scarf design is the representation of three pieces of grain, the kernels and stems of which are yellow and outlined in green; radiating behind the word "CRUZ" and the sombrero design are white lines. The color gray represents transparent area and is not part of the mark.
