Dear Mr. Juneau:
The above-referenced application has been reassigned to me, as Aubrey Biache is on maternity leave. I have reviewed your October 28 response. There are a few remaining issues which, with your express authorization, can be resolved through issuance of an Examiner’s Amendment.
Section 2(d) Refusal
Currently, I am not willing to withdraw the Section 2(d) likelihood of confusion refusal. However, with the below amended identification, I would be willing to withdraw the refusal:
Class 9:
Protective gloves for industrial use; Protective work gloves;Articles of protective clothing with built in armor for protection against accident or injury for use in special forces, military, firefighting, and law enforcement;fire fighters, police, industrial workplace;Garments and clothes for protection against fire; Gloves for protection against accidents;Protective body armor, namely, ballistic, bullet, blast, slash and stab resistant clothing
As noted above, with your express authorization, I can make the above changes via an Examiner’s Amendment.
Please do not hesitate to contact me with any questions or concerns. Thank you!
Sincerely,
Bianca
