The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Identification of Goods and Services
The highlighted wording in the identification of goods and services is vague and/or combines services from more than one International Class. Specifically, medical clocks are classified in Class 014, which is the correct class for timekeeping instruments including clocks and watches. Software must be classified in Class 009 if it is downloadable software or Class 042 if it is software as a service and/or non-downloadable software. Finally, applicant must specify the user and/or field of use for the medical software application being offered under the mark.
The following identification of goods and services is suggested, if accurate:
Downloadable medical software application used on phones, tablets and laptops for patient security, information, stimulation, motivation and precaution for use with [specify, e.g. heart monitoring equipment, medical clocks, for use in the field of oncology, for monitoring hemophiliacs, etc.], in Class 009.
Clocks in the nature of a security, information, stimulation, motivation and precaution clock for medical use, in Class 014.
Marketing; commercial information agency services; market analysis; conducting market surveys, in Class 035.
Educational support services, namely, conducting classes, seminars, conferences and workshops in the field of pharmaceuticals, medical preparations, disorders or conditions as well as patient information, in Class 041.
Medical and pharmaceutical information; medical services, in Class 044.

Multi-Class Application
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least five classes; however, applicant submitted a fee(s) sufficient for only four classes. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
