Good afternoon Christopher,
I am the assigned trademark examining attorney for the above-referenced application. I am writing because I recently reviewed the above-referenced application and there is one minor issue that I believe we can resolve easily by e-mail or phone. Specifically, below is the issue that will need to be resolved before the application may proceed:
Identification of Goods
The wording “hubs” in the identification of goods is indefinite and must be clarified because the term can include a variety of hubs such as “hub cap covers” or “hub caps” in class 12. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may substitute the following wording, if accurate:
“Bicycles, and bicycle structural parts therefor; Electric bicycles; Bicycle frames; Bicycle parts, namely, brakes, chains, cranks, front forks, gears, handlebars, handlebar grips, handlebar stems, horns, wheel hubs, kickstands, pedals, saddles, seats, seat posts, sprockets, wheels, wheel spokes” in Class 12.
Please respond as to whether applicant agrees to this amendment by Tuesday, June 25, 2019. If applicant agrees, I can make the changes via examiner’s amendment and approve for publication. I can also issue a Priority Action if you need more time to consider the issue. If you are unable to respond, an Office Action will issue.
