Without admission of any kind, in response to the 2(e)(4) refusal in the office action issued on June 27, 2019, and pursuant to the Trademark Examining Attorney's kind suggestion in that office action, applicant is submitting this claim of acquired distinctiveness under section 2(f). Please note that the common law trademark rights to "Sueoka" and "Sueoka Market" were assigned to Applicant by Jan, Inc. by written assignment dated April 4, 2019, so Applicant's claim is as assignee of Jan, Inc.


SECTION 2(f) Claim of Acquired Distinctiveness, based on Five or More Years' Use
The mark has become distinctive of the goods/services through the applicant's substantially exclusive and continuous use of the mark in commerce that the U.S. Congress may lawfully regulate for at least the five years immediately before the date of this statement.
