As I indicated in my voicemail, I am the Trademark Examining Attorney to whom has been reassigned the application submitted on behalf of your client, Texas A&M AgriLife Research (Docket No. 11000191.171), for the word mark LAZER.  The application has now come off of suspension and is almost ready for publication, but there is still one issue with the application which appears to have been overlooked by the previous Trademark Examining Attorney.  However, this issue can be resolved by me through an Examiner’s Amendment with your authorization.

 

Specifically, the identification of goods identifies “Zoysiagrass” as its goods in International Class 031, which appears to be a type of grass.  However, it is not clear specifically how this good is being provided to consumers, either in seed form or sod.  Therefore, this needs to be clarified.  I have suggested the following amendment to the identification of goods.  Please review for accuracy.

 

            Class 031:        “Zoysiagrass in the nature of grass seeds and sod.”

 

Please indicate whether the above-suggested amendment to the identification of goods is authorized, and I will make the change by Examiner’s Amendment.  Should you have any questions or concerns, please do not hesitate to call or email me.
