Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 88393253 STAR DUST(Standard Characters, see http://uspto.report/TM/88393253/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Office Action has stated that there is a potential refusal based on an earlier filed application, serial no. 88249112. However, this application was abandoned on September 29, 2019. While it has been revived, this was only on November 6, 2019 which is the new effective filing date of the '112 application. As such, the present application now has an earlier effective filing date of April 23, 2019. The Office Action further asks about the legal entity type of the corporation. It is, in fact, a Limited Liability Company (LLC). Further, the application has been rejected in view of Reg. No. 4856903. Based on research, it appears that the registrant has abandoned this mark. The renewal deadline for the prior registration opens on November 17, 2020. The present mark, if another Office Action is issued, will have a response deadline in about July of 2020. As such, please kindly suspend prosecution of this application until the prior registration is marked abandoned in the USPTO database. Thank you, Michael Feigin, Esq.
