This examiner’s amendment responds to applicant’s communication dated 1/7/2020.  Pursuant to TMEP §707.03, applicant is advised of the following status of the application.  Prior to issuance of this examiner’s amendment, the following issues were outstanding with this application:

·         Drawing Does Not Reproduce Satisfactorily

·         Mark Description and Color Claim

In light of applicant’s response to the Office action and the amendments detailed below, the examining attorney has determined the following:

·           Drawing Requirement is SATISFIED;

·           Mark Description and Color Claim Requirement is SATISFIED.

Application has been amended as shown below.  As agreed to by April Davis, Owner, on 1/27/2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.

MARK DESCRIPTION AND COLOR CLAIM AMENDED

 

The following statements describing color in the mark replace the current description of color in the mark of record:

 

Color claim: “Color is not claimed as a feature of the mark.”

 

Description: “The mark consists of a five-sided diamond shape with a border made of two lines and with the letters “MF” stylized and intertwined in the center of the design, with the “M” formed at the top of the intertwined letters and the “F” facing backwards.”
