AMENDMENT TO IDENTIFICATION OF GOODS Applicant hereby amends and reclassifies its goods as follows: ?Cosmetics only for personal care, excluding all hair care products; non-medicated skin care

the nature of medicated lozenges? in Class 005 ?Vape cartridges, namely, electronic cigarette refill cartridges sold empty? in International Class 034 Section 2(d) Refusal ? Likelihood of Confusion
Registration of the applied-for mark was refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 1678229, 4258257, 4164377, 5261669, 5476161 and 5783670. The cited
registrations are as follows: RAVE (Reg. No. 1678229) for ?hair styling preparations; namely, sculpting spritz, protective curl revitalizer, protective styling mousse, hair gel and hair spray? in
Class 003; RAVE (Reg. No. 4258257) for ?Water recreational products, namely, water skis, wakeboards, water mats in the nature of a foam flat mat with handles to slide down water park slides, and
repair patches for the foregoing; inflatable water recreational products, namely, trampolines, bounce platforms, water slides, float tubes used to tow behind a boat, pontoon water slides, and
inflatable playgrounds in the nature of outdoor play structures, volleyball sets consisting primarily of a volleyball and an inflatable structure supporting a net, swimming pool floats, swimming pool
loungers in the nature of floating lounge chairs, and repair patches for the foregoing; water ski trainers in the nature of a catamaran-style inflatable device which allows new skiers to sit on the

EXTREME ENERGY NOOTROPIC (Reg. No. 5476161) for ?dietary and nutritional supplements for enhancing athletic performance, endurance, strength and muscle building containing nootropics? in Class 005;
RAVE (Reg. No. 5783670) for ?make-up brushes? in Class 021. Comparison of the Marks and the Goods as Amended Applicant has amended its goods to be more definite and to avoid any overlap with various
goods of the six cited registrations for ?RAVE? marks that currently coexist on the register. Accordingly, Applicant submits that with the weakness of ?rave? and that its goods no longer overlap with
any of the cited marks that the citations be withdrawn. Prior-Filed Pending Applications Applicant notes that the filing dates of pending U.S. Application Serial Nos. 86895819 and 87767142 precede
Applicant?s filing date. Applicant requests suspension pending final disposition of these two earlier-filed referenced applications. CONCLUSION Applicant submits that it has responded to the
