The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES:
RECITATION OF SERVICES
The wording “entertainment services in the nature of radio segments, television segments, concerts, and events in the fields of music and variety; hosting of digital music, video, and entertainment content” in the recitation of services is unacceptable because the nature of these services is unclear and because it could include items classified in another class. Applicant must amend the identification by indicating specifically the nature of these services. Furthermore, applicant must classify the services correctly. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
The applicant is strongly urged to consult the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual for assistance with identifying and classifying goods and services in this trademark application. See TMEP §1402.04
The following substitute wording is suggested, if accurate:
International Class 038
Radio broadcasting services; television broadcasting services; providing access to digital music websites on the Internet
International Class 041
Entertainment services, namely, the provision of continuing segments featuring music and variety shows delivered by radio and television; entertainment, namely, live music concerts; providing on-line music, not downloadable

(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

FAILURE TO RESPOND/ABANDONMENT OF SPECIFIC SERVICES
If applicant does not respond to this Office action within the six-month period for response, the following services will be deleted from the application: “entertainment services in the nature of radio segments, television segments, concerts, and events in the fields of music and variety; hosting of digital music, video, and entertainment content.” The application will then proceed with the services, namely, “radio broadcasting services; television broadcasting services” in International Class 038 only. See 37 C.F.R. §2.65(a)-(a)(1); TMEP §718.02(a).

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
