EXPLANATION OF FILING

Applicant respectfully requests that Application Serial No. 88381582 be amended to substitute

Section 44(e) in place of the current Section 1(b) basis, as Applicant intends to rely on Section

44(e) as a basis for registration. Applicant further requests that the Section 1(b) basis and all

goods thereunder be deleted upon acceptance of U.K. Registration No. 3390374, attached hereto

to perfect the Section 44(e) basis. If and only if, the Examining Attorney does not accept the
