TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES:
NAME OF LIVING INDIVIDUAL – INQUIRY
To register a mark that consists of or comprises the name of a particular living individual, including a first name, pseudonym, stage name, or nickname, an applicant must provide a written consent personally signed by the named individual. 15 U.S.C. §1052(c); TMEP §§813, 1206.04(a).
Accordingly, if the name in the mark does not identify a particular living individual, applicant must submit a statement to that effect (e.g., “The name shown in the mark does not identify a particular living individual.”).
However, if the name in the mark does identify a particular living individual, applicant must submit both of the following:
(1) The following statement: “The name shown in the mark identifies a living individual whose consent to register is made of record.” If the name is a pseudonym, stage name, or nickname, applicant must provide the following statement: “EDIE PARKER FLOWER identifies _______ (specify actual name), a living individual whose consent is of record.”
(2) A written consent, personally signed by the named individual, as follows: “I, EDIE PARKER FLOWER, consent to the use and registration of my name, EDIE PARKER FLOWER, as a trademark and/or service mark with the USPTO.”

Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
THIS PARTIAL REQUIREMENT APPLIES ONLY TO THE GOODS SPECIFIED THEREIN
The wording “phone cases” in Classes 9, “barware, namely, trays” and “incense holders” in Class 21, as well as “vaporizer pipes, water pipes, lighters, rolling trays, glass tips for vaporizer pipes” in Class 34 in the identification of goods are all indefinite and must be clarified. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. The applicant should specify that the phone cases are cell phone cases or cases for smartphones, and that the trays in Class 21 are serving trays. Furthermore, the applicant must specify that the vaporizer pipes are actually smokeless cigarette vaporizer pipes, and that the water pipes are actually tobacco water pipes in order for proper classification in Class 34, primarily because metal water pipes are generally classified in Class 6 while non-metal water pipes are classified in Class 19. In addition, the applicant should specify that the lighters are actually cigarette lighters and that the rolling trays are smokers’ rolling trays. Lastly, the wording “glass tips for vaporizer pipes” needs further specification as to the exact nature of the goods for proper classification.
Applicant may substitute the following wording, in bold, if accurate:
Cell phone cases. IC 9
Barware, namely, serving trays and cocktail shakers; Incense holder in the nature of incense burners. IC 21
Smokeless cigarette vaporizer pipes, tobacco water pipes, matches, cigarette paper, cigarette lighters, smokers’ rolling trays, tobacco grinders, tobacco jars, tobacco storage boxes made of acrylic, tobacco storage boxes made of glass, ashtrays composed of non-precious metal, ashtrays composed of acrylic; glass tips for vaporizer pipes, namely, ________ (specify by common commercial name); cigarette holders. IC 34

MULTIPLE-CLASS APPLICATION REQUIREMENTS
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods that are classified in at least 10 classes; however, applicant submitted a fee sufficient for only 9 classes. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
