PRIORITY ACTION

DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On June 21, 2019, the trademark examining attorney and James Yang discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
CLASSIFICATION AND IDENTIFICATION OF GOODS AND SERVICES
Computer software is a product classified in International Class 9 if it is (1) recorded on media (such as CDs) or (2) downloadable and thus can be transferred or copied from a remote computer system for use on a long-term basis. TMEP §1402.03(d). However, on-line non-downloadable software is considered a computer service in International Class 42, unless it is non-downloadable game software provided online or for temporary use, which is classified in International Class 41. See TMEP §§1402.03(d), 1402.11(a)(xii).
For example, the following are acceptable identifications for software in International Class 9: “recorded desktop publishing software,” “downloadable software for word processing,” and “downloadable mobile applications for managing bank accounts.” Additionally, the following are acceptable identifications for software in International Class 42: “providing temporary use of on-line non-downloadable software development tools” and “providing temporary use of non-downloadable cloud-based software for calculating energy costs.” Finally, the following are acceptable identifications for non-downloadable game software in International Class 41: “providing online non-downloadable game software” and “providing temporary use of non-downloadable game software.” For assistance with software classification and identifications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual.
Applicant may substitute the following wording, if accurate:
Class 9: Traffic management equipment, namely, display monitors, computers, auto compasses and {specify whether recorded or downloadable} software to monitor, measure and manage traffic, {specify whether recorded or downloadable} software that hosts, displays, visualizes and analyzes traffic data, software that uses, collects, visualizes and displays map data; {Specify whether recorded or downloadable} Software that collects, stores, filters and aggregates real-time transportation data collected from roadway monitoring sources, namely, fixed-location point sensors, camera images, tag-based sensors attached to vehicles, vehicle probes, weather sources, weather sources of information for traffic purposes, third-party sources, third-party sources of information for traffic purposes, connected vehicles, event feeds and social media where the transportation data is output via user interface portals, namely, computer monitors, mobile applications and web pages
Class 35: Data processing services, namely, processing of traffic signal data, transportation corridor performance data, fixed location sensor data, vehicle probe data, and data generated by connected and automated vehicles; Collection in the nature of systemization of traffic signal data and transportation corridor performance data in computer databases
Class 38: Electronic transmission of reports and alerts to others based on traffic signal data and transportation corridor performance data
Class 39: Traffic information; Traffic information services; Providing road and traffic information; Physical storage of traffic signal data, transportation corridor performance data, fixed location sensor data, vehicle probe data, data generated by connected and automated vehicles
Class 42: Traffic Planning Services; Customized software development in the field of traffic and transportation; Traffic and transportation engineering services, namely, providing performance data and analysis based on traffic signal data and transportation corridor performance data; Electronic storage of traffic signal data, transportation corridor performance data, fixed location sensor data, vehicle probe data, and data generated by connected and automated vehicles

MULTIPLE-CLASS APPLICATION REQUIREMENTS
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
The fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class. See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a). See more information regarding the requirements for maintaining the lower TEAS RF fee and, if these requirements are not satisfied, for adding classes at a higher fee using regular TEAS.
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least 5 classes; however, applicant submitted a fee(s) sufficient for only 3 class(es). Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
