This is in response to the Official Action dated June 18, 2019.

 

REMARKS

 

In the Official Action the Examining Attorney refused registration based on two extant registrations, namely U.S. Registration Nos. 5,414,550 and 5,414,575, and pending Application Serial No. 87/585,664.  

 

The Examining Attorney’s attention is directed to the Trademark Office assignment database.  The Examining Attorney will note that the recorded owner of the two registrations and the application is now the same as for the present application.  In view of this, the Examining Attorney’s refusals are rendered moot.

 

Applicant requests, in view of the foregoing, that the refusals be withdrawn.

 

All issues in the Official Action having been addressed, applicant requests a speedy publication.

 

If the Examining Attorney has any questions, she is encouraged to contact applicant’s counsel.
