I.  IDENTIFICATION OF GOODS/SERVICES - Indefinite in Part:

 

As noted, the identification of goods and/or services is unacceptable as indefinite in large part because it lacks sufficient specificity and because the goods/services fall into additional classes.  As a general matter, due to the great deal of indefiniteness for a wide variety of goods, not all possible options are suggested below.  However, please note that, applicant must:

 

-        specify the nature/type for numerous goods suggested below,

 

-        delete the duplicative wording (i.e., “galoshes; gaiters” in IC 25 “Skateboards; Skates; shin guards (sports articles); treadmills; dumb-bells; kettle bells; free weights; medicine balls; gym balls; gym bars; sit up benches; exercise bikes; elliptical machines; weight benches; weight towers; trampolines; Fishing equipment; swimming jackets; and floats for bathing and swimming” in IC 28 , etc.),

 

-        delete the repeated and unnecessary inclusion of “(clothing)” in IC 25, as well as, the parenthesis throughout (as they are not permitted in an identification as used),

 

-        clarify what is meant by “playing bowls; bowls (games); bowls bags; sporting equipment for use in gymnastics, namely,…exercise and gymnastic banners in IC 28,

 

-        amend “covers for animals” in IC 18 as suggested below or it will be beyond the scope of the goods in the foreign registration and may only proceed solely to Section 1(b), and

 

-        etc. (as discussed in great detail below).

As such, applicant must amend the identification to make it definite along the lines suggested below.  Accordingly, applicant may adopt the following identification, if accurate:

If applicant adopts the suggested amendment of the identification of goods and/or services, then applicant must amend the classification to International Class(es) 4, 8, 9, 12, 14, 16, 18, 25, 27 & 28.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§805, 1401.

 

III.  ADDITIONAL CLASSES:

 

If the applicant prosecutes this application as a combined, or multiple-class, application, the applicant must comply with each of the following:

 

(1)  The applicant must list the goods and/or services by their international class number (as listed above); and

         

(2)  The applicant must submit a filing fee for each international class of goods/services not covered by the fee already paid.  The applicant has already submitted a filing fee for three classes.

·       Update your correspondence email address, if needed, to ensure you receive important USPTO notices about your application.

 

·       Beware of misleading notices sent by private companies about your application.  Private companies not associated with the USPTO use public information available in trademark registrations to mail and email trademark-related offers and notices – most of which require fees.  All official USPTO correspondence will only be emailed from the domain “@uspto.gov.”
