INTRODUCTION

 

This Office action is in response to applicant’s communications dated June 15, 2019 where applicant:

 

     (1) submitted a substitute verified specimen; and

     (2) submitted a new mark drawing.

 

The examining attorney has reviewed the applicant’s communications and determined the following:

 

     (1)applicant’s substitute verified specimen is acceptable and made of record, and the requirement to submit a substitute verified specimen is satisfied;

     (2) applicant’s new mark drawing is acceptable and made of record;

 

AMENDMENT OF APPLICATION

 

Application has been amended as shown below.  As agreed to by Michael D. Rearden on July 5, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the services are not permitted.  37 C.F.R. §2.71(a).

 

 

AMENDMENT OF MARK DESCRIPTION AND COLOR CLAIM

 

The following description of the mark replaces the current description of record and the following statements describing color in the mark replace the current description of color in the mark of record:

The mark consists of the stylized brown wording “REVEN CONCEPTS”. The wording “REVEN” is underlined by a brown, straight, horizontal line. The wording “CONCEPTS” appears beneath this line. To the left of this wording appear two concentric circles: a white circle within a brown circle. White and brown curved lines form hills in the bottom of the white circle. Within the white circle and above the hills, four white coniferous trees appear. Within the white circle and above and behind the trees, brown mountains appear. Within and extending beyond the concentric circles appears a brown hawk in flight outlined in white. All wording and design elements appear on a rectangular white background.

The colors brown and white are claimed as a feature of the mark.
