DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On June 13, 2019, the trademark examining attorney and Michael David Rearden discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
SUMMARY OF ISSUES
(1) Specimen Refusal – New Specimen or Amendment of Filing Basis Required
SPECIMEN REFUSAL – NEW SPECIMEN OR AMENDMENT OF FILING BASIS REQUIRED
Registration is refused for the following specimen-related reasons.
First, registration is refused because the specimen in International Class 41 is merely a photocopy of the drawing or a picture or rendering of the applied-for mark, and thus fails to show the applied-for mark in use in commerce with the services for each international class. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); In re Chica, 84 USPQ2d 1845, 1848 (TTAB 2007); TMEP §§904, 904.07(a), 1301.04(g)(i).
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C). Specimens comprising advertising and promotional materials must show a direct association between the mark and the services. TMEP §1301.04(f)(ii).
Applicant may respond to this refusal by satisfying one of the following for each applicable international class:
(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application and (b) shows the mark in actual use in commerce for the services identified in the application. A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20: “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.” The substitute specimen cannot be accepted without this statement.
(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by the individual identified in the Priority Action section above, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. TMEP §707. Any amendments to the identification of services may clarify or limit the services, but may not add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

AMENDMENT OF MARK DESCRIPTION AND COLOR CLAIM
The following description of the mark and color claim replace the current description and color claim of record:
The mark consists of the stylized brown wording “REVEN CONCEPTS”. The wording “REVEN” is underlined by a brown, straight, horizontal line. The wording “CONCEPTS” appears beneath this line. To the left of this wording appear two concentric circles: a black circle within a brown circle. Black and brown curved lines form hills in the bottom of the black circle. Within the black circle and above the hills, four black coniferous trees appear. Within the black circle and above and behind the trees, brown mountains appear. Within and extending beyond the concentric circles appears a brown hawk in flight outlined in black.
The colors brown and black are claimed as a feature of the mark.

CLARIFICATION OF LEGAL ENTITY
Applicant has clarified its entity type for the record by specifying its name and entity to read Reven LLC, a limited liability company organized under the laws of Texas. See 37 C.F.R. §2.32(a)(3); TMEP §§803.03 et seq .
APPLICANT MAY WISH TO SEEK TRADEMARK COUNSEL
Because of the legal technicalities and strict deadlines involved in the USPTO application process, applicant may wish to hire a private attorney specializing in trademark matters to represent applicant in this process and provide legal advice.
