SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
Applicant seeks registration of “SIROS” for medical devices for use in treating cancer and other chronic diseases in Class 10. The cited registrations are “SYROS” in standard character and stylized form for pharmaceutical preparations and compounds for use in the treatment of cancer in Class 5.
Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis: (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services. See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.
COMPARISON OF THE MARKS
Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression. Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v). “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).
Applicant’s mark is “SIROS.” Registrant’s marks are “SYROS.”
The marks are similar because they each comprise one word terms which contain virtually identical letter strings in the identical order. Indeed, the only difference between these marks is applicant’s substitution of the letter “I” for the letter “Y” in registrant’s mark. However, this substitution does not obviate likely consumer confusion because these letters are often interchangeable and does not distinguish the commercial impression.
Moreover, applicant and registrant’s marks are phonetic equivalents and thus create the same commercial impression. The marks are essentially phonetic equivalents and thus sound similar. Similarity in sound alone may be sufficient to support a finding that the marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv).
Further, the stylization of registrant’s mark non-standard character mark does not obviate because applicant’s mark is standard character and registrant also owns the standard character mark for the same term. A mark in typed or standard characters may be displayed in any lettering style; the rights reside in the wording or other literal element and not in any particular display or rendition. See In re Viterra Inc., 671 F.3d 1358, 1363, 101 USPQ2d 1905, 1909 (Fed. Cir. 2012); In re Mighty Leaf Tea, 601 F.3d 1342, 1348, 94 USPQ2d 1257, 1260 (Fed. Cir. 2010); 37 C.F.R. §2.52(a); TMEP §1207.01(c)(iii). Thus, a mark presented in stylized characters and/or with a design element generally will not avoid likelihood of confusion with a mark in typed or standard characters because the word portion could be presented in the same manner of display. See, e.g., In re Viterra Inc., 671 F.3d at 1363, 101 USPQ2d at 1909; Squirtco v. Tomy Corp., 697 F.2d 1038, 1041, 216 USPQ 937, 939 (Fed. Cir. 1983) (stating that “the argument concerning a difference in type style is not viable where one party asserts rights in no particular display”).
Thus, applicant and registrant’s marks are confusingly similar.
COMPARISON OF GOODS
Applicant’s goods are likely complementary to registrant’s goods and used for the same purpose. Where evidence shows that the goods at issue have complementary uses, and thus are often used together or otherwise purchased by the same purchasers for the same or related purposes, such goods have generally been found to be sufficiently related such that confusion would be likely if they are marketed under the same or similar marks. See In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 1567, 223 USPQ 1289, 1290 (Fed. Cir. 1984) (holding bread and cheese to be related because they are often used in combination and noting that “[s]uch complementary use has long been recognized as a relevant consideration in determining a likelihood of confusion”); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1272 (TTAB 2009) (holding medical MRI diagnostic apparatus and medical ultrasound devices to be related, based in part on the fact that such goods have complementary purposes because they may be used by the same medical personnel on the same patients to treat the same disease).
Additionally, due to the similarity of the marks applicant’s goods are sufficiently related to support a likelihood of confusion. Where the marks of the respective parties are identical or virtually identical, as in this case, the degree of similarity or relatedness between the goods and/or services needed to support a finding of likelihood of confusion declines. See In re i.am.symbolic, llc, 116 USPQ2d 1406, 1411 (TTAB 2015) (citing In re Shell Oil Co., 992 F.2d 1204, 1207, 26 USPQ2d 1687, 1689 (Fed. Cir. 1993)), aff’d, 866 F.3d 1315, 123 USPQ2d 1744 (Fed. Cir. 2017); TMEP §1207.01(a).
Accordingly, applicant is refused registration under Section 2(d) of the Lanham Act.
REQUIRED AMENDMENT TO IDENTIFICATION OF GOODS
In an identification, an applicant must, be specific and all-inclusive, and avoid using indefinite words or phrases. TMEP§§1402.01, 1402.03(a). Further, applicant may amend the identification to list only those items that are within the scope of the goods set forth in the initial application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §§1402.06 et seq., 1402.07. Scope is generally determined by the ordinary meaning of the wording in the identification. TMEP §1402.07(a).
Applicant may substitute the following wording, if accurate:
Class 10: Medical devices for use in treating or diagnosing Cancer and Acute and Chronic Devastating Diseases and Conditions beyond Cancer, namely {Specify conditions beyond cancer, i.e. “cirrhosis of the liver”}; Medical devices for use in treating Cancer and Acute and Chronic Devastating Diseases and Conditions beyond Cancer, namely {Specify conditions beyond cancer, i.e. “cirrhosis of the liver”}; Medical devices, namely, infusion pumps for delivering measured amounts of solutions into the bloodstream over time; Medical devices, namely, radiation devices in the nature of ultraviolet, visible, or infra-red light boxes for counteracting the effects of viruses, bacteria and pathogens in the blood and blood components; Medical apparatus and units for dosage, measuring and monitoring, namely, drug delivery devices and systems; Medical apparatus, namely, infusion and injection devices for administering drugs; Diagnostic apparatus for the detection of cancer; Implantable radiation therapy devices consisting of delivery agents, namely {Specify common commercial name of delivery agents, i.e. “Y-90 resin microspheres”} consisting of compounds that facilitate delivery of a wide range of pharmaceuticals; Implantable radiation therapy devices consisting of radioactive seeds with or without a bioabsorbable carrier assembly; Injection device for pharmaceuticals; Medical apparatus and instrument for diagnostic use, namely, apparatus for medical diagnostic testing in the fields of cancer or other tissue-based diagnostic testing, cytology and cell-based testing; Medical apparatus for detecting cancer; Medical apparatus for introducing pharmaceutical preparations into the human body; Medical device for detecting cancer; Medical device for treating cancer; Medical diagnostic apparatus for detecting cancer; Medical diagnostic apparatus for testing Cancer and Acute and Chronic Devastating Diseases and Conditions beyond Cancer, namely {Specify conditions beyond cancer, i.e. “cirrhosis of the liver”}
