Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 88362456 I*BALL (Stylized and/or with Design, see http://uspto.report/TM/88362456/mark.png) has been amended as follows:

EVIDENCE
Evidence in the nature of After reviewing both specimen images of mark #2947759, there can be no confusion between the design or name as they have a period after the word ball. Mark #2947759 also has the letter "I' above or a top the word ball. Our mark (#88362456) and design is completely opposite with the asterisk always displayed between the letter "I" and the word "Ball". Our eyeball design is always displayed underneath the mark at all times to distinguish itself and results in an undeniable identification. In the case of mark #5130427, the entire mark and image is different and cannot be complete without the entire set of words "IBall4Life" used together. If abbreviated, it doesn't make the #5130427 mark official per registered mark. There will be no confusion as #88362456 mark is entirely different. The #5130427 mark has a stylized lettering of the literal elements "IBall" above the stylized lettering of the literal elements "4Life". Again, our mark (#88362456) and design is completely opposite with the asterisk always displayed between the letter "I" and the word "Ball". Our eyeball design is always displayed underneath the mark at all times to distinguish itself and results in an undeniable identification. Our mark #88362456 will always have the image of the eyeball to distinguish this brand from all other trademarks on every item we offer. We will be sure there is no confusion of our goods vs. marks #2947759 and #5130427. Both our mark and image will offer a very distinct impression on consumers and with our image there will be no way to likely confuse our mark from the others. Consumers will unlikely believe that mark #88362456 comes from or interferes with marks #2947759 or #5130427 due to the authenticity of each original design. Please consider the years that my family and I have put into working on creating this design. The approval of this mark will certainly be a blessing for us and we believe it will bring joy to others. There are lots of athletes that are great, but don't get the recognition they deserve and we want to help make sure they're noticed in and outside of their game. In the event you feel our application should still be denied, we respectfully ask that you could allow us the opportunity to appeal any final decisions made.
