SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
· Identification of Goods in International Class 9
IDENTIFICATION OF GOODS IN INTERNATIONAL CLASS 9
The wording in the identification of goods in International Class 9 is unacceptable as written because it fails to indicate the nature of the applied-for goods with sufficient specificity. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
The wording “internet-enabled lock technology” is indefinite and must be amended to clarify that the goods are an electronic lock technology system, and specify what the system consists of, such as downloadable software, or electronic locksets and keypads.
Applicant may adopt the following identification, if accurate (changes highlighted in bold italic):
International Class 9:
Intelligent, internet-enabled electronic lock technology system consisting of [specify what the system consists of, e.g., downloadable software, electronic cylindrical locksets and keypads, etc.] allowing an administrator to remotely assign a time-sensitive access code for a user
