| On December 17, 2019, the attorney Breanna McCarthy left a voicemail for the examiner, Matt Einstein, regarding this mark and
applicant's other mark (Flip Flop Way of Life, Serial Number 88359185). The examiner followed up with Breanna's call by sending an email.
In the emails Breanna explained that the specimens that were submitted were in fact how the applicant uses the mark in commerce. The examiner told Breanna that they would notate this in
the file and move the applications along.
Breanna then asked the examiner whether she needed to submit a response to the office action and he informed her that she did not.
It appears that the note was only added to application number 88359185 but not for this application as well. Application number 88359185 was published while this application was not. Breanna was under the impression that the amendments were to be made for both marks since Breanna and the examiner
were speaking about both marks during the voicemail and subsequent emails.
