ENTITY CLARIFICATION REQUIRED

 

The designation “LTD” is included in applicant’s name, which generally indicates a Limited Company or Limited Liability Company; however, the legal entity is set forth as a “corporation.”  Therefore, applicant must specify whether the legal entity is a limited company, a limited liability company or a corporation and amend the application accordingly.  TMEP §803.03(h); Appendix D; see 37 C.F.R. §§2.32(a)(2), (a)(3)(ii), 2.61(b).

 

If applicant is a limited liability company, applicant must amend the legal entity and provide the country or state under whose laws it is organized.  TMEP §803.03(h).  If applicant is a corporation, applicant must provide the legal name of the corporation and U.S. state or foreign country of incorporation or organization.  See TMEP §803.03(c).

 

If, in response to the above request, applicant provides information indicating that it is not the owner of the mark, registration will be refused because the application was void as filed.  See 37 C.F.R. §2.71(d); TMEP §§803.06, 1201.02(b).  An application must be filed by the party who owns or is entitled to use the mark as of the application filing date.  See 37 C.F.R. §2.71(d); TMEP §1201.02(b).

 

Applicant must also note the mark description requirement below.

 

MARK DESCRIPTION AMENDMENT REQUIRED

 

Applicant must submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

The following description is suggested, if accurate: 

 

The mark consists of the stylized letters “SY” in white letters inside and slightly overlapping a single, red broken line vertical rectangular border, the right side of the border line is broken, with a small red square appearing between the broken vertical lines; the white lettering “SY” appears over a shaded red square and above red non-Latin characters that are over a white background and are intersected by a red, horizontal line.

 

Applicant must also note the translation statement/information about wording requirement below.

 

INFORMATION ABOUT WORDING IN THE MARK REQUIRED

 

To permit proper examination of the application, applicant must provide the following information:

 

(1)  Explain whether the wording in the mark “SY” has any meaning or significance in the industry in which the goods and/or services are manufactured/provided, any meaning or significance as applied to applicant’s goods and/or services, or if such wording is a term of art within applicant’s industry. 

 

(2)  Submit an English translation of all foreign wording in a mark and a transliteration (the phonetic spelling of the pronunciation, in Latin characters) of all non-Latin characters in a mark.  If the wording does not have meaning in a foreign language, applicant should so specify.   

 

The format for an English translation and transliteration: The non-Latin characters in the mark transliterate to “{specify, e.g., “SHOU” and “YAO”, if accurate}” and this means “to catch the people who love fashion, advanced thinking and more street fashion” in English. 

 

The format for when there is no English translation or meaning of the transliteration: The non-Latin characters in the mark transliterate to ““{specify, e.g., “SHOU” and “YAO”, if accurate}” and this means “to catch the people who love fashion, advanced thinking and more street fashion” in English.  / or, if the non-Latin characters have no mean, then specify “and this has no meaning in a foreign language.
