Dear Ms. King,

 

I am the Trademark Examining Attorney at the U.S. Patent and Trademark Office examining your application for U.S. TRADEMARK APPLICATION NO. 88352192 DOUBLE PROTECTION LAYER MW FLAME MITIGATION DEVICE...  I have identified the following issues with the application:

 

  1. Amended Description of Mark Required:  Applicant must submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

The following description is suggested, if accurate: 

The mark consists of a shaded circle with a solid border. Inside the top portion of the border is the text DOUBLE PROTECTION LAYER” with a shaded and stylized “M” on the left and a shaded and stylized “W” on the right, and inside the bottom portion of the border is the text FLAME MITIGATION DEVICE”, a diamond, and the text “VAPOR LOCKING SPOUT. Inside the circle is a shield with the text FLAME SHIELD in large font above the text SAFETY SYSTEM in smaller font. The top middle of the shield has a solid circle with a border containing a stylized M above a stylized WThe shield casts a shadow to the right side of the circle.   

 

 

  1. Amendment to Identification of Goods Required:  The original wording in the application, which liberally uses commas and not “and,” creates an ambiguity as the liquid fuel containers are not sufficiently connected to the material composition.  Inserting the word “and” into the below spots in the Identification clears up the ambiguities and makes the Identification definite.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.

 

A suggestion for acceptable wording is (suggested changes in bold):

 

Class 6:  (Based on Intent to Use) Liquid fuel containers and industrial and commercial containers, namely, metal storage drums, and chemical oil containers, namely, jerrycans, all made of metal; Liquid fuel containers and industrial and commercial containers, namely, metal storage drums, and chemical oil containers, namely, jerrycans, all made of metal and with flame mitigation device help prevent combustion; metal containers for liquid fuel with flame mitigation device help prevent combustion

 

Class 20:  (Based on Use in Commerce) Liquid fuel containers and industrial and commercial containers, namely, plastic storage drums, and chemical oil containers, namely, jerrycans, all made of plastic; non-metal containers for liquid fuel; Liquid fuel containers and industrial and commercial containers, namely, plastic storage drums, and chemical oil containers, namely, jerrycans, all made of plastic and with flame mitigation device help prevent combustion; non-metal containers for liquid fuel with flame mitigation device help prevent combustion
