As discussed over the phone, I would like to resolve the following issues:
1. App Ser. Nos. 88351857 (MEM ROBOTICS), 88351766 (MEM ROBOTICS), and 88351795 (MAKE EM MOVE ROBOTICS): disclaimer of “ROBOTICS”.
2. App. Ser. No. 88367136 (eye design): I would like to propose a more specific design description that has been accepted in applicant’s copending application no. 87848839:
“The mark consists of two circles, each with the top half shaded and the bottom half un-shaded, stylized to resemble eyes, with stylized eyelashes on the outer side of each circle.”
3. App. Ser. No. 88381826 (bird design):
a. I would like to propose a more specific design description:
“The mark consists of a stylized flying bird with four outstretched wings.”
b. I would like to clarify the identification of goods as follows (deleted language
struck):
“Electrical devices to be plugged into wall outlets having a heating element and which dispenses a fog, a haze and/or a mist; Fog generators; Fog machines; Fog making machines; Outdoor automated mist system for insect and pest control comprising a fog generator, a haze generator and/ora mist generator”
Please call me with any questions and/or let me know if these changes are acceptable at your soonest convenience, and I can change them through an examiner’s amendment. Please note that there will be a 2(d) refusal for App. Ser. No. 88351857, so while all the other applications will have Examiner’s Amendments, I will send out a priority action/examiner’s amendment for App. Ser. No. 88351857.
