Dear Mr. Novakovic,

Thank you for your messages.  I have now had an opportunity to check with the Applicant, and can confirm that the disclaimer is acceptable:

No claim is made to the exclusive right to use “SHADOWBOX CARDS” apart from the mark as shown.

We look forward to receipt of the Examiner’s Amendment.

Best regards,

Lori

U.S. Trademark Application Serial No. 88351635 (DELIGHTED SHADOWBOX CARDS); Attorney Docket No. UWP-22

Dear Ms. Krafte,

My name is Miroslav Novakovic and I am the assigned trademark examining attorney for the above-referenced application.   I left you a voicemail on this but wanted to send an email too in case that is easier for you and your client.   This application will be ready to move forward once the applicant agrees to disclaim the wording “SHADOWBOX CARDS” in the applied-for mark for being descriptive of or generic for applicant’s goods.  Specifically, the identification of goods in the application states that applicant’s goods involve “greeting cards.” Therefore, the wording “SHADOWBOX CARDS” describes the applicant’s goods themselves as applicant is selling greeting cards that have a three dimensional feature.

Please let me know by phone or email if you agree to allow me to correct the above by an examiner's amendment or if you have any questions about the application.

Thank you for your cooperation.

Sincerely,

Miroslav Novakovic, Esq.
