The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
However, before the mark can be approved for publication, the applicant must respond to the following requirement:
Disclaimer
In this case, applicant must disclaim the word “MARTINI” in International Class 33 and the words “RACING” and “CICLISMO” in International Class 41 because they are not inherently distinctive. These unregistrable terms at best are merely descriptive of an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods and services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
With respect to the word “martini” in International Class 33, a “martini” is “A cocktail made from gin (or vodka) and dry vermouth, typically garnished with an olive or a twist of lemon.” See the attached excerpt from http://en.oxforddictionaries.com/definition/us/martini. The applicant’s Class 33 goods are “Alcoholic beverages except beers.” The foregoing wording is so broad as to include martinis and alcoholic ingredients for making martinis. Thus, “MARTINI” is descriptive of an ingredient and/or characteristic of applicant’s Class 33 goods.
With respect to the word “ciclismo” in International Class 41, the English translation of the Italian word “ciclismo” is “cycling.” See the attached excerpt from http://translate.google.com/#view=home&op=translate&sl=it&tl=en&text=ciclismo. The applicant’s Class 41 educational, entertainment, and physical fitness services pertain or relate to “cycling and racing.” Therefore, the words “racing” and “ciclismo” describe the subject matter and/or fields in which the applicant’s services are provided.
