In a previous Office action dated June 5, 2019, the trademark examining attorney refused registration of the applied-for mark based on the following: Trademark Act Section 2(d) for a likelihood of confusion with a registered mark and Trademark Act Section 2(e)(4) for being primarily merely a surname.
In addition, the following refusal has been withdrawn: Section 2(d) refusal. See TMEP §§713.02, 714.04.
Upon issuance of the below Examiner’s Amendment, the outstanding issue will be satisfied.
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by David Dubin, attorney for applicant, on June 27, 2019, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707.
The following claim of acquired distinctiveness under Trademark Act Section 2(f) is added to the record:
The mark has become distinctive of the goods and/or services as evidenced by the ownership of active U.S. Registration No(s). 0137977 and 0930423 on the Principal Register for the same mark for sufficiently similar goods and/or services.
