The following refusal(s) and/or requirement(s) is/are maintained and continued:
1. The refusal to register under Section 2(d) of the Trademark Act as to U.S. Registration Nos. 5612311 and 5043181;
2. The refusal to register under Sections 1 and 45 of the Trademark Act based on no bona fide intent to use on lawful goods because the goods are not in compliance with either the Controlled Substances Act or the Food, Drug and Cosmetic Act;
3. The requirement for a fully acceptable identification of goods;
4. The requirement for more information about the goods pursuant to 37 CFR Section 2.61(B).
See id. These refusals and/or requirements will be made final once this application is removed from suspension, unless a new issue arises. See TMEP §716.01.
