SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
A mark is merely descriptive if “it immediately conveys information concerning a feature, quality, or characteristic of [an applicant’s] goods or services.” In re N.C. Lottery, 866 F.3d 1363, 1367, 123 USPQ2d 1707, 1709 (Fed. Cir. 2017) (citing In re Bayer Aktiengesellschaft, 488 F.3d 960, 963, 82 USPQ2d 1828, 1831 (Fed. Cir. 2007)); TMEP §1209.01(b); see DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Abcor Dev. Corp., 588 F.2d 811, 814, 200 USPQ 215, 218 (C.C.P.A. 1978)).
Applicant’s mark “SNAP BRIM” is merely descriptive of the way applicant’s goods are attached to safety helmets, namely they snap onto the brim of the helmet. The term “SNAP,” which is a method of securing something to something else through the use of snap fasteners, is commonly used in the protective gear industry to refer to how accessories are attached to the helmet. See attached definitions of “Snap” from merriam-webster.com and en.oxforddictionaries.com noting that a snap is a fastener; see also attached evidence from us.msasafety.com noting that the accessory “easily snaps into all MSA helmets.” The term “BRIM” is commonly used to refer to the protruding base of a hat that protects the face, ears, and neck from the sun. See attached evidence from blog.tenthstreethats.com discussing the anatomy of a hat. Moreover, “BRIM” is likewise descriptive of applicant’s product because it is commonly used in connection with hard hats or safety helmets to refer to the protruding ledge where accessories, like applicant’s product are attached. See attached evidence from sfiorbimax.com, ironworkergear.com, and hivissupply.com selling full brim hard hats and accessories that attach at the brim.
Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the goods and/or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
In this case, both the individual components and the composite result are descriptive of applicant’s goods and do not create a unique, incongruous, or nondescriptive meaning in relation to the goods. Specifically, applicant’s mark, “SNAP BRIM” describes the location and manner that consumers will use to attach the product to its intended companion, namely by snapping it to the brim of a safety helmet.
Thus, applicant’s mark is refused registration under Section 2(e)(1) of the Lanham Act.
REQUEST FOR INFORMATION
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the goods in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the goods is available on applicant’s website is insufficient to make the information of record;
(2) If these materials are unavailable, applicant should submit similar documentation for goods of the same type, explaining how its own product or services will differ. If the goods feature new technology and information regarding competing goods is not available, applicant must provide a detailed factual description of the goods. Factual information about the goods must make clear how they operate, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement; and
(3) Applicant must respond to the following questions:
1. Does the wording in the mark “SNAP BRIM” have any significance in the protective gear trade or industry?
2. Does the wording “SNAP BRIM” have any significance as applied to applicant’s goods?
3. Is the wording “SNAP BRIM” a “term of art” within applicant’s industry?
4. Do applicant’s goods attach to the brim of a safety helmet
5. Does applicant’s goods use a snap fastener or a closure that snaps onto the helmet?
6. Do applicant’s goods make a snapping noise when applied to safety helmets?

Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
For this application to proceed, applicant must explicitly address each refusal and/or requirement in this Office action. For a refusal, applicant may provide written arguments and evidence against the refusal, and may have other response options if specified above. TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.
