SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

 

Registration of the applied-for mark AUDIO GO is refused because of a likelihood of confusion with the mark AUDIOGO in U.S. Registration No. 4266402.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the attached registration.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods and/or services of the parties.  See 15 U.S.C. §1052(d).  Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).  In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017).  Only those factors that are “relevant and of record” need be considered.  M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018). 

 

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis:  (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services.  See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

 

COMPARISON OF THE MARKS

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).  “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.”  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).

 

The applied-for mark AUDIO GO and the registered mark AUDIOGO make similar overall commercial impressions because they each consist of the words “AUDIO” and “GO” in combination, resulting in identical sounds and meanings.

 

The compared marks are identical except for a slight difference in appearance between applicant’s and registrant’s mark, which appears as a compound word with no space separating the words, that is, “AUDIOGO”; and applicant’s mark, which appears as multiple words with space separating the words, that is, “AUDIO GO”.  As such, the marks are identical in sound and virtually identical in appearance, and are thus confusingly similar for the purposes of determining likelihood of confusion.  See, e.g., Seaguard Corp. v. Seaward Int’l, Inc., 223 USPQ 48, 51 (TTAB 1984) (“[T]he marks ‘SEAGUARD’ and ‘SEA GUARD’ are, in contemplation of law, identical [internal citation omitted].”); In re Best W. Family Steak House, Inc., 222 USPQ 827, 827 (TTAB 1984) (“There can be little doubt that the marks [BEEFMASTER and BEEF MASTER] are practically identical”); Stock Pot, Inc., v. Stockpot Rest., Inc., 220 USPQ 52, 52 (TTAB 1983), aff’d 737 F.2d 1576, 222 USPQ 665 (Fed. Cir. 1984) (“There is no question that the marks of the parties [STOCKPOT and STOCK POT] are confusingly similar.  The word marks are phonetically identical and visually almost identical.”). 

 

The different design elements in the marks are unlikely to differentiate the marks because the word portion in marks generally creates a more dominant impression on purchasers, is more likely to be remembered by them, and be used by them to refer to or request the goods and/or services.  In re Aquitaine Wine USA, LLC, 126 USPQ2d 1181, 1184 (TTAB 2018) (citing In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012)); TMEP §1207.01(c)(ii).  Thus, although marks must be compared in their entireties, the word portion is often considered the dominant feature and is accorded greater weight in determining whether marks are confusingly similar, even where the word portion has been disclaimed.  In re Viterra Inc., 671 F.3d at 1366-67, 101 USPQ2d at 1911 (citing Giant Food, Inc. v. Nation’s Foodservice, Inc., 710 F.2d 1565, 1570-71, 218 USPQ2d 390, 395 (Fed. Cir. 1983)).

 

Therefore, because the marks consist of the same words in combination, the marks make similar overall commercial impressions.

 

COMPARISON OF THE GOODS AND SERVICES

 

Applicant’s mark is for the services “Advertising services; Advertising trading and management services; Advertising services, namely, placement of digital audio advertising on the internet, internet radio, podcast, simulcast streams, and on-demand audio content; Advertising trading and management services via an online platform, namely, a demand-side platform (DSP) that allows users to bid on digital audio advertising inventory and manage advertising exchange and data exchange accounts; Advertising services, namely, implementation, optimization, and measuring of digital audio advertising for others; Advertising services, namely, distribution of digital audio advertising materials on internet radio, podcasts, simulcast streams, and on-demand audio content; Advertising services, namely, measuring, reporting, and tracking of advertising performance; Advertising services, namely, measuring, reporting, tracking and billing of advertising expenditures” and “Software as a service; Software as a service featuring an online platform, namely, a demand-side platform (DSP) that allows users to bid on and buy digital audio advertising inventory and manage advertising exchange and data exchange accounts; Software as a service featuring an online platform for placement of digital audio advertising on the internet, internet radio, podcast, simulcast streams, and on-demand audio content; Software as a service featuring an online platform that allows users to programmatically implement, optimize, and measure digital audio advertising; Software as a service featuring an online platform for distribution of digital audio advertising materials on internet radio, podcasts, simulcast streams, and on-demand audio content; Software as a service featuring an online platform for measuring, reporting, and tracking advertising performance; Software as a service featuring an online platform for measuring, reporting, tracking and billing of advertising expenditures” while registrant’s mark is for the goods “Downloadable audio recordings featuring the spoken word and music; downloadable electronic publications, namely, e-books, audio books and music soundtracks featuring the spoken word and music; downloadable MP3 files and MP3 recordings featuring the spoken word and music; compact discs and audio tapes featuring the spoken word and music and all being sold together with booklets featuring the spoken word and lyrics contained in the audio recordings”, “Retail, wholesale, mail order and electronic shopping services featuring literary works, broadcast programs, original content, audio books and other information source material” and “Electronic transmission, broadcast, electronic delivery, reception and other dissemination of audio content, information, text and data, whether in real or delayed time, multimedia content, and webpages, all via the telecommunications network; transmission services via the internet, featuring MP3 files; streaming of audio material; provision of information and advisory services, namely, the provision of such services via computer networks on-line from a computer database or provided via the Internet”.

 

The compared goods and/or services need not be identical or even competitive to find a likelihood of confusion.  See On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir. 2000); TMEP §1207.01(a)(i).  They need only be “related in some manner and/or if the circumstances surrounding their marketing are such that they could give rise to the mistaken belief that [the goods and/or services] emanate from the same source.”  Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007)); TMEP §1207.01(a)(i).

 

Applicant’s and registrant’s goods and services are both used for overlapping purposes, namely the delivery of audio.  Applicant’s audio sale spaces directly overlap with the audio retail services in the registration.  Moreover applicant’s software performs the same function as registrant’s transmission services, namely delivering audio content.

 

In conclusion, because the applied-for mark and the registered mark make similar commercial impressions and because the goods and services are closely related there is a likelihood of confusion between the two marks and the applied-for mark must be refused registration under Trademark Act Section 2(d).

 

IDENTIFICATION OF SERVICES

 

The identification of services contains wording that is indefinite and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Specifically applicant must address issues with the following wording:

 

  • The wording “software as a service” in class 42 is vague.  Applicant must identify the specific functions of the non-downloadable software provided as a service as well as the field of use, if applicable, e.g., Software as a service (SAAS) services featuring software for analyzing advertisement statistics, etc.

 

Applicant may amend the identification to clarify or limit the services, but not to broaden or expand the services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted services may not later be reinserted.  See TMEP §1402.07(e).

DISCLAIMER REQUIRED

 

Applicant must disclaim the wording “AUDIO” because it merely describes applicant’s goods and/or services, and thus is an unregistrable component of the mark. See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a). A “disclaimer” is a statement in the application record that an applicant does not claim exclusive rights to an unregistrable component of the mark.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 979-80, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.  A disclaimer does not physically remove the disclaimed matter from the mark or otherwise affect the appearance of the mark.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d at 979, 144 USPQ2d at 433; TMEP §1213.

 

Applicant’s services are specifically for the delivery of audio content.  Therefore the word “AUDIO” in the applied-for mark merely describes the function of the services and must be disclaimed.

 

Applicant should submit a disclaimer in the following standardized format:

 

No claim is made to the exclusive right to use “AUDIO” apart from the mark as shown.

 

If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark. See In re Stereotaxis Inc., 429 F.3d 1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. MARK DRAWING AND COLOR CLAIM

 

Applicant must clarify whether color is a feature of the mark because, although the drawing shows the mark in color, the application does not state whether color is a feature of the mark.  37 C.F.R. §§2.37, 2.52(b)(1), 2.61(b); see TMEP §807.07(a)-(a)(ii).

 

Applicant may respond to this requirement by satisfying one of the following:

 

(1)       If color is not a feature of the mark, applicant must submit a black-and-white drawing of the mark to replace the color drawing.  See TMEP §807.07(a)(i).  However, any other amendments to the drawing will not be accepted if they materially alter the mark.  37 C.F.R. §2.72; see TMEP §§807.14 et seq.  Applicant must also submit a revised description of all literal and design elements in the mark, deleting any reference to color, if appropriate.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  The following description is suggested, if accurate:  The mark consists of “AUDIO GO” with three vertical lines appearing over the word “GO”.

 

(2)       If color is a feature of the mark, applicant must submit a statement (a) listing all the colors that are claimed as a feature of the mark and (b) describing all the literal and design elements in the mark that specifies where each color appears in those elements.  37 C.F.R. §§2.37, 2.52(b)(1); TMEP §807.07(a)-(a)(ii).  Generic color names must be used to describe the colors in the mark, e.g., red, yellow, blue.  TMEP §807.07(a)(i)-(ii).  If black, white, and/or gray represent background, outlining, shading, and/or transparent areas and are not part of the mark, applicant must so specify in the description.  See TMEP §807.07(d).  The following color claim and description are suggested, if accurate: 

 

Color claim: The color steel blue is claimed as a feature of the mark.

 

Description: The mark consists of “AUDIO GO” with three vertical lines appearing over the word “GO”, all in steel blue.
