Requirement: Mark Description Amendment 

 

Applicant must submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark, especially with respect to the face in the fireball and the color black.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

The following description is suggested, if accurate: 

 

The mark consists of the wording "CHANNELFIREBALL" in stylized font and capital letters, written as a single word, with the word "CHANNEL" in orange and the word "FIREBALL" in teal; at left, the design of an orange and red fireball with white teeth and red tongue emerges from a teal television; the color black appears in the mouth of the fireball design, and in the background of the television; other appearances of the color black represent background, outlining, shading and/or transparent areas and are not part of the mark. 

 

Alternatively, if you require more time to resolve the issues presented, please let me know, and I will issue a Priority Action instead. In any event, I hope you will let me know which course of action you prefer.
