In this case, applicant must disclaim the wording “BIG DATA IDENTITY ENRICHMENT” because it is not inherently distinctive. These unregistrable term(s) at best are merely descriptive of a quality, characteristic, function, feature, purpose, or use of applicant’s services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
Applicant’s services include, inter alia, software for managing patient medical information and for use as a healthcare patient information database within the medical and healthcare fields. See Application.
The attached evidence shows BIG DATA refers to the large volume of structured and unstructured data and IDENTITY ENRICHMENT refers to technology solutions for use in updating and enhancing patient information to create a holistic view of the patient in the field of healthcare. See attachments A-C. As used in association with the identified services, this wording immediately and aptly conveys information about the services. That is, these terms inform that the applicant’s software is for use in managing and processing patient medical information within the medical and healthcare fields. As BIG DATA IDENTITY ENRICHMENT merely describes applicant’s services, a disclaimer is proper and required.
Descriptive terms are not afforded protection because businesses and competitors should be free to use descriptive language when describing their own goods and/or services to the public in advertising and marketing materials. See In re Styleclick.com Inc., 58 USPQ2d 1523, 1527 (TTAB 2001).
