RESPONSE This is in response to the Office Action dated December 17, 2019. Reconsideration of this Application is respectfully requested in view of the following remarks. REMARKS In the Office Action, the Examiner refused to accept Applicant’s claim of acquired distinctiveness in part because Applicant had not yet filed an amendment to allege use for the 4MEDICA BIG DATA MPI mark. Applicant notes that it subsequently filed its amendment to allege use on May 14, 2020, and the amendment to allege use was accepted by the Examiner on June 6, 2020. As stated therein, Applicant’s mark 4MEDICA BIG DATA MPI has been in use in commerce since at least as early as March 11, 2013. Applicant confirms that its claim of acquired distinctiveness for the BIG DATA MPI portion of the mark is based on Applicant’s substantially exclusive and continuous use of the 4MEDICA BIG DATA MPI mark in connection with the services identified in the Application for at least the five years immediately before the date Applicant made the 2(f) claim. Additionally, the Examiner advised that Applicant’s prima facie showing based on an allegation of five years’ use is insufficient to show acquired distinctiveness in part because the phrase BIG DATA MPI is “highly descriptive of a function of Applicant’s services.” The Examiner asked that Applicant provide additional evidence of acquired distinctiveness. In response, Applicant hereby submits the Affidavit of Gregg Church, President of Applicant. The Affidavit and its attached evidence demonstrate that the relevant public understands the primary significance of the phrase BIG DATA MPI as identifying the source of Applicant’s services. Therefore, Applicant respectfully requests that its 2(f) claim in part be accepted. CONCLUSION In view of the foregoing, and since the Examining Attorney has found no similar registered or pending mark that would bar registration under Section 2(d) of the Trademark Act, the Applicant respectfully requests that the application be approved for publication. An early publication date is respectfully requested. |
