In response to the substantive refusal(s), please note the following:

The Examining Attorney has refused registration citing a duplicate registration, namely Registration No. 4296729. Applicant respectfully submits that Registrant did not file the requisite Declaration of Use and/or Excusable Nonuse under Section 8 prior to the expiration of the six-month grace period on September 5, 2019.  As such, the registration will be cancelled in due course. Noting that no other objections have been raised, Applicant respectfully requests approval of the instant application for publication.
