Michael –

Thanks for your time on the phone today.  I’ve had a chance now to confer with the client and they’ve agreed that this much narrower description of goods and services would be acceptable to them:

“Three-dimensional porous implant structure used to foster bone in-growth specifically for use on articulating knee replacement implants, and not orthopedic fixation devices, comprised of artificial materials and sold through a network of hospital-based representatives.”

You’ll note that I’ve specifically excluded the “orthopedic fixation devices” from the goods and services of the prior mark.  Please let me know whether this is acceptable.

Dave:

It was a pleasure speaking with you.  Based on our discussions I proposed the following amended identification language:

Implant coatings used to foster bone growth specifically for use on orthopedic surgical implants comprised of artificial materials and sold to medical device manufacturers.

If the implant is made of living materials/tissue/scaffolding then the proposed identification would be:

Implant coatings used to foster bone growth specifically for use on orthopedic surgical implants comprised of living tissue or scaffolding made of living tissue and sold to medical device manufacturers.

Please Note:  If the product is for use with living tissue implants then the international classification must change from 010, to 005.

Please let me know if the proposed amendment is acceptable and I will do an Examiner’s Amendment and move the application along.

Regards—
