In response to the substantive refusal(s), please note the following:

Applicant respectfully submits the following in response to Office Action No. 1. REQUEST FOR SUSPENSION The Examining Attorney has refused registration on a 2(d) basis stating there may be a likelihood of confusion between the source of origin of the applied-for mark and the owner of the cited registration for CHRONO BOMB! and design (Reg. No. 4975558). ?Under 37 C.F.R. ?2.67, an examining attorney has the discretion to suspend an application ?for good and sufficient cause.?? TMEP ? 716.02. Accordingly, Applicant respectfully submits that good and sufficient cause exists for suspension of this Application because Applicant and the cited Registrant are in the process of discussing whether to enter into a concurrent use agreement and have not reached a final decision on that matter.
