I wanted to reach out to you regarding the above-referenced application because the application has just one minor issue that can be resolved using an Examiner’s Amendment and without the need for an Office Action.  In particular, in order to approve the application, I would require disclaimer of the term “SOUNDS”.  The term “SOUNDS” refers to “recorded auditory material” and therefore describes the nature of applicant’s goods, namely, that is sells musical recorded auditory material.  See http://www.merriam-webster.com/dictionary/sound Furthermore, the term “SOUNDS” has been disclaimed in several third-party registrations for goods that are the same as, or similar to, applicant’s goods.  See, e.g., U.S. Registration Nos. 5644855, 5305370, and  5185307. 

 

If you would like to proceed with an Examiner’s Amendment, please confirm that you approve of the disclaimer of the term “SOUNDS” no later than 5 PM ET on Friday, May 17, 2019.  Also, please do not hesitate to contact me if you have any questions or concerns.
