OFFICIAL USPTO EMAIL - Trademark Applications Serial Nos. 88328796 MAGNIFICENT NOISE & 88328814 MN  - Response Required

Dear Ms. Heraty,

I am the assigned trademark examiner for the above-referenced applications.  I have reviewed the applications and the issues to be resolved are as follows.

Please let me know by email or phone, if you agree that the changes below are acceptable, I will issue an Examiner's Amendment in each stating:

For Both Applications:

amended identification of services

The identification of services is amended to read as follows:

International Class 41:           Audio recording and production; Consulting services in the field of podcast production development for providing podcasts for entertainment purposes and audio production training; Entertainment services in the nature of development, creation, production and post-production services of multimedia entertainment content; Entertainment services in the nature of development, creation, production, distribution, and post-production of podcasts and other audio entertainment content; Production of radio programs

See TMEP §§1402.01, 1402.01(e).

For MN in 88328814:

Unnecessary Disclaimer Removed

Applicant has authorized the withdrawal of applicant’s voluntary disclaimer of “M OR N”.  The disclaimer is hereby deleted from the application.  See 15 U.S.C. §1056(a); TMEP §1213.01(c).

Amended description of the mark

The following description of the mark replaces the current description of record:

The mark consists of a purple hexagon containing the stylized and overlapping letterings "MN" in white with a white microphone extending from the top of the letter "N".  The other white in the mark is not claimed as a feature of the mark and represents transparent and background area.

See 37 C.F.R. §§2.37, 2.72; TMEP §§808 et seq.

added color claim

The following color claim is added to the record:

The colors purple and white are claimed as a feature of the mark.

37 C.F.R. §2.52(b)(1); TMEP §807.07(a)(i).

Please let me know by email or phone by 12 PM EST on Tuesday, 5/21/2019, if you agree to allow me to correct the above by Examiner's Amendment in each application.

Please do not hesitate to contact me should you have any questions.  If I do not hear from you by that time, I will have to issue an Office action in each.

Best regards,
